NC Divorce Lawyers - How do I file a claim for divorce?
Friday, October 23, 2009, 06:32 PM
Raleigh, North Carolina (CaymanMama.com) — The decision to get a divorce is never an easy one. The North Carolina divorce lawyers at the law firm of Gailor, Wallis & Hunt, PLLC can help to make the process easier and more understandable.
One of the most asked questions is: How do I file a claim for divorce?
When beginning to file for a divorce in North Carolina, the first stop is the preparation of documentation and then filing the complaint in court.
The complaint outlines to the court and to the other spouse (once served) that the filing party wishes for the court to dissolve the marriage. It also records any requests, such as child custody, child visitation, child support, spousal support, property division, attorney’s fees and court costs.
According to the Raleigh divorce attorney’s website: “After the complaint is filed, the defendant must be served with a copy of the complaint. The defendant has thirty (30) days from the date of service of the complaint to serve an answer. If the defendant requests an extension, it is common for that party to be granted an additional thirty (30) days to serve an answer.
“The defendant may raise a counterclaim that is a part of the same pleading containing the answer. If the defendant files a counterclaim, the plaintiff must serve a reply within thirty days (or sixty days if an additional thirty day extension is granted).”
In some cases, both parties will agree on all outstanding issues. However, in some cases, a trial may be required to resolve any of the claims which aren’t agreed upon.
While a lawsuit is not always necessary in the case of divorce, most can be settled by an agreement prior to or following the filing of the complaint.

Jury Awards Accident Victim $1.1 Million
Wednesday, October 21, 2009, 08:50 PM
Accident attorneys from the Lurie Law Firm, a renowned personal injury law firm based in New York City, fight for the rights of a delivery driver injured on the job and secure jury award. Andres Soto, a self-employed delivery truck driver, was injured after he was pinned between his vehicle and another parked delivery truck that was struck from behind and sustained serious injuries to his elbow. After hiring the renowned accident law firm of Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a jury awarded Mr. Soto $1.1 million in damages. “Mr. Soto was standing behind his truck and in front of another parked truck that was struck by a third truck driven by Joseph Lambusta,” says George W. Ilchert, Esq., a partner with the Lurie Law Firm. “The struck truck was propelled forward, and Soto was pinned between the two parked trucks.” According to Ilchert, Mr. Soto was transported to Kings County Hospital Center, in Brooklyn, following the accident and it was determined that he sustained serious fractures to his right elbow. Mr. Soto underwent surgery and extensive physical therapy to correct the damage. In addition to being out of work for three months, his contention was that he continues to suffer residual pain and a permanent, residual reduction of his right elbow's range of motion. “As a result,” Ilchert says, “Mr. Soto sought the recovery of damages for his past and future pain and suffering. We agreed that he was entitled to that recovery.” Soto ultimately sued Lambusta and the owner of Lambusta's truck, Kraft Foods Global Inc., alleging that Lambusta was negligent in the operation of his vehicle and that Kraft Foods Global was vicariously liable for his actions. “Defense counsel conceded liability and the trial went forward to address Mr. Soto’s damages,” Ilchert says. “Ultimately, the jury decided that Mr. Soto was entitled to 1.1 million dollars.” Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, located at 475 Park Avenue South (32nd Street) New York, NY, 10016, specializes in representing victims of all types of accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and busses, babies with cerebral palsy and other brain damage, general medical malpractice, saws and electrical tools without guards, and slip and fall cases. New York Accident Injury Law Firm Secures Award for Fall Victim
Wednesday, October 21, 2009, 08:40 PM
Personal injury lawyers from the Lurie Law Firm, a renowned accident injury law firm based in Manhattan, secure a $2,500,000 award for a mason injured on the job. Online PR News – 20-October-2009 – A non-union mason who was injured after falling from a 20-foot retaining wall while working at Package Pavement, a company that manufactures cement and asphalt products for the construction and building repair industries, has secured a $2,500,000 settlement award with the help of Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a leading Manhattan law firm that fights for the rights of those injured on the job. "Michal Cimbalak testified that he was working on a 20-foot retaining wall and building a foundation for a piece of equipment that Package Pavement was installing when he slipped and fell to the ground as he stood on a brace and poured the final pour," says George W. Ilchert, Esq., a partner with the Lurie Law Firm. "Mr. Cimbalak sued the company that owned and controlled the property, Package Pavement Co Inc., claiming labor law violations, in failing to provide him with protective equipment while he worked at a height, claiming that Package Pavement was aware of the danger." According to Ilchert, Mr. Cimbalak sustained a herniated disc, a torn ligament, and a skull fracture as a result of the accident. Following the fall, he underwent cranial surgery and arthroscopic knee surgery. He sustained a traumatic brain injury, aphasia, cognitive disorders, and a seizure disorder and could not return to work following the accident. As a result of his injuries, Mr. Cimbalak receives ongoing care at the NYU Epilepsy Center and the Rusk Institute. "Package Pavement maintained that although Cimbalak had sustained a serious injury, he had recovered well and was able to work," says Ilchert. "They claimed that his seizures were controlled by medication and that his knee and back injuries were pre-existing." However, attorney Robert R. MacDonnell and the team at Lurie, Ilchert, Mac Donnell and Ryan, LLP, called on six experts in the medical field who had examined Mr. Cimbalak and refuted those claims. "As a result, the case was settled following jury selection and Mr. Cimbalak and his family were awarded $2,500,000," said Ilchert. "We are pleased that justice was served." Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, is a New York City Personal Injury Law Firm located at 475 Park Avenue South (32nd Street) New York, NY, 10016, The firm specializes in representing victims of all types of personal injury accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and buses, babies with cerebral palsy and other brain damage, general medical malpractice attorney, saws and electrical tools without guards, and slip and fall cases. Rapid Results in Personal Injury Cases Are Important to Victims
Tuesday, October 13, 2009, 05:12 PM
Accident injury lawyers from the Lurie Law Firm, a renowned personal injury firm based in New York, say that expediting cases should be a priority for the well-being of victims. According to George W. Ilchert, Esq., part of the team of Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a leading Manhattan law firm that has been working with personal injury victims for decades, it is important to find a resolution in accident cases as quickly as possible. “When someone is suffering as a result of an accident, the last thing they need is a long, drawn out legal process,” says Ilchert. “Accident victims need to focus on putting their lives back together as quickly as possible. That is why personal injury law firms must act quickly toward a resolution in accident cases.” According to Ilchert, a good personal injury lawyer will waste no time in moving a case to resolution through settlement or trial. “At Lurie Law, for example, we frequently prepare a summons and complaint on the same day that we have been retained,” says Ilchert. “Our motto has always been that we will get maximum results in minimum time. If you are the victim of an accident, this is what you should expect from your lawyer.” Ilchert says that every step of a personal injury case should be completed as rapidly as possible. In some cases, crowded court calendars caused by an insufficient number of judges and courtrooms, may bring delays to a particular accident case, but the law firm representing the victims should always be expected to prepare cases for resolution as quickly as possible. “At Lurie Law, we never are the cause of delays in our clients’ cases,” says Ilchert. “We have earned a reputation for always being ready to move forward during every phase of each case and we are always ready for trial before a judge and jury. This has resulted in settlements that would otherwise have been impossible, not only in strong cases, but in problematic cases as well.” Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, located at 475 Park Avenue South (32nd Street) New York, NY, 10016, specializes in representing victims of all types of accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and busses, babies with cerebral palsy and other brain damage, general medical malpractice, saws and electrical tools without guards, and slip and fall cases. In Accident Cases, Don’t Trust Just Any Lawyer
Tuesday, October 13, 2009, 10:32 AM
Personal injury attorneys from the Lurie Law Firm, a reputable Manhattan accident injury firm, say that personal injury cases should not be handled by just any lawyer. George W. Ilchert, Esq., a partner with Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a renowned New York personal injury law firm that only handles personal injury cases, says that specialized personal injury firms are the only way to go when you or a loved one have been the victim of an accident. “We made a conscious effort to handle only personal injury cases,” says Ilchert, “because it allows are team to stay focused through practicing only one area of law.” The last thing that an accident victim wants to do is think about hiring an attorney, but hiring one is essential to getting the justice and the compensation that the victim deserves. Unfortunately, according to Ilchert, many victims make the mistake of hiring a general practice attorney that may not be as well versed in accident law as a personal injury attorney would be. “A quality personal injury law firm can give offer a special perspective that other attorneys will not have and will be more experienced in things like workman’s compensation and personal injury law,” says Ilchert. “Personal injury law experts can better navigate the complexities of the legal system when it comes to accident law, while the average lawyer may not be familiar with personal injury law and case precedent.” According to Ilchert, hiring anyone but a personal injury lawyer will ultimately cost the victim more time and money. “Personal injury law is complex and accident cases involve intensive, unglamorous work that only someone with specialized legal training and experience can accomplish,” says Ilchert. The staff at the Lurie Law Firm understands that need for specialized care, according to Ilchert, because they work exclusively with personal injury cases and have garnered millions of dollars in awards for their clients. Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, located at 475 Park Avenue South (32nd Street) New York, NY, 10016, specializes in representing victims of all types of accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and busses, babies with cerebral palsy and other brain damage, general medical malpractice, saws and electrical tools without guards, and slip and fall cases. Criminal Defense Lawyer Says a Client Should Demand Personal Attention from Their Attorney
Tuesday, October 13, 2009, 10:28 AM
Experienced Manhattan defense lawyer Lisa Pelosi, Esq., knows what it takes to garner the best defense when charged with a crime. “There are two things that can set a criminal defense attorney apart from his or her peers,” says Lisa Pelosi, Esq., (www.New-York-Criminal-Attorney-Now.com), a criminal defense lawyer that has represented New York residents for more than two decades. “The first is experience and the other is personal attention.” According to Pelosi, people who are dealing with an arrest, being investigated or awaiting an appeal, are going through a very difficult time. The process, she says, can be very stressful and upsetting, so it is important to choose a criminal defense lawyer that will guide the defendant from start to finish. “A good defense attorney will not only fight aggressively for the client, but also takes the time to give the client the personal service that they deserve,” says Pelosi. “That sort of attention is essential to helping the defendant work through the complex criminal justice system.’ Pelosi says that anyone charged with a crime should understand their rights and their options as they move through the process. A good criminal defense attorney will do this with their client every step of the way, she says. “My clients are free to call me anytime and ask any questions about their case or express any concerns,” says Pelosi. “My goal is you give my clients my best defense, but it is also my goal to help them deal with and get through a difficult time. I always fight for my clients, keep them informed, and listen to them. That is what helps me stand apart from my peers.” Lisa Pelosi, Esq. is a criminal defense attorney based in Manhattan, NY. Malpractice Law Firm Champions the Rights of Patients
Monday, October 5, 2009, 03:33 PM
As the debate over healthcare continues, the attorneys at The Lurie Law Firm, a New York personal injury law firm that specializes in medical malpractice cases, say that protecting a patient’s right to justice is paramount. New York City Malpractice Lawyer Online PR News – 05-October-2009 – According to the staff of medical malpractice experts at Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a leading Manhattan injury law firm that specializes in championing for the rights of victims of medical malpractice, a number of doctors have called for limitations on a patient's ability to sue for malpractice within the framework of the current government healthcare debate, calling many malpractice suits frivolous. "A reputable law firm never takes frivolous medical malpractice lawsuits, as some would like the public to believe," says George W. Ilchert, Esq., a partner with the firm of Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com). "When it comes to medical malpractice lawsuits, the law requires plaintiffs to call upon respected physicians to testify that the defendant was negligent and malpractice insurance carriers generally hire tough lawyers to fight for the physician responsible According to Ilchert, that keeps "frivolous" suits out of the court system or from going too far. Ilchert notes that professionals such as lawyers, engineers and doctors, are well-paid for their specialized expertise and when any of them makes a mistake that causes harm to their client or, in the case of a doctor, their patient, they should be held accountable. "Trampling on patients’ rights when it comes to medical malpractice, will not lower health care costs but will likely diminish the level of care that patients currently receive," says Ilchert. "Ask any one of the countless medical malpractice victims that we have represented and successfully won awards for and you will understand the pain and suffering that medical malpractice can cause." Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, located at 475 Park Avenue South (32nd Street) New York, NY, 10016, specializes in representing victims of all types of accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and busses, babies with cerebral palsy and other brain damage, general medical malpractice, saws and electrical tools without guards, and slip and fall cases. Attorneys Require a Strong Internet Marketing
Saturday, October 3, 2009, 05:07 PM
In addition to having a top-notch, visually stimulating, information-rich website that is easy to navigate, attorneys need an Internet marketing strategy that can grow and keep up with the latest search trends. The best way for a law firm to achieve these goals is to hire a professional website development firm that specializes in law firm website design and search engine optimization tailored to the specific needs of attorneys. When it comes to those who provide legal services, particularly criminal defense and personal injury lawyers, the growth of a practice depends on the strength of its online presence. Unlike the past when potential clients turned to the local yellow pages to find legal service providers, clients today look to the Internet. This is why a great marketing plan is essential and law firms that passively wait for potential clients to fall into their lap will ultimately fail. In addition, attorney websites should be informative for potential clients and easy to navigate. Law firms looking to create or boost their online presence should turn to a company that is proficient in website development for this niche market. Connecticut Private Investigator Offers Tips on Spotting a Cheating Spouse
Thursday, October 1, 2009, 11:10 AM
Bridgeport Private Investigator, specializing in infidelity investigations, says there are a number of signs that your partner may be unfaithful. Online PR News – 01-October-2009 – "Throughout my career, first in law enforcement and later as a Connecticut private investigator, I have been involved in many undercover assignments and high profile investigations," says Christopher Paoletti, Founder and President of Infidelity Investigations (http://www.infidelitypolice.com), a full service Connecticut private investigation agency specializing in infidelity cases that have been the subject of divorces throughout the country. "Since founding Infidelity Investigations in 2001, my team and I have caught hundreds of cheating spouses because we know what to look for." According to Paoletti, there are a number of "signs" to look for if you believe that your spouse may be unfaithful, with the first being your own gut reaction. "If you have a feeling that your spouse may be cheating," says Paoletti, "then you have enough reason to do a little more digging." When approaching your spouse with your gut feeling, watch his or her reaction, Paoletti says. If they tell you that you are "crazy" for making such accusations or that you are "imagining" things, this may be a sign of infidelity and a way to mask his or her behavior. Increased use of the Internet, and excessive emailing or text messaging can also be a sign of infidelity, says Paoletti. "The Internet makes it very easy to communicate with someone when you cannot talk to them in person or by phone," he notes. "If excessive Internet use is apparent, shutting down the computer or changing screens when you walk into the room may also be a sign of a cheating spouse." According to Paoletti, another sign of a cheating spouse may be going to work early, coming home late, or working overtime without compensation. The spouse may even be taking long trips to the grocery store or gym. The truth is, he says, is that none of this may really be happening. Lastly, Paoletti says that a spouse who hides home or cell phone bills, leaves the cell phone in the car or keeps it on them at all times, or has a cell phone that you don’t have access too is likely being deceptive. "Although these signs may not necessarily guarantee that your spouse is cheating," Paoletti says, "They are sure signs of deception, especially, when he or she did not have these tendencies in the past." Established in 2001, Infidelity Investigations is a bonded, fully insured and licensed Bridgeport private investigation firm in the State of Connecticut, specializing in infidelity investigations, surveillance, background investigations, attorney investigation services, and GPS tracking. NY Accident Attorneys Offer Advice on What Steps to Take After Being Injured in a Car Accident
Thursday, October 1, 2009, 11:00 AM
Personal Injury Attorneys from Lurie Law Firm, a leading accident law practice based in Manhattan, say that there are a number of time-sensitive steps that should be taken following an automobile accident. “When injured in a car accident, it is important that the necessary steps are taken to ensure that the accident victim gets the compensation they deserve,” says George W. Ilchert, Esq., a partner with Lurie, Ilchert, Mac Donnell and Ryan, LLP (http://www.limrlaw.com), a leading New York law firm specializing in personal injury cases. “There are so many deadlines to be met for filing certain claims and if the appropriate action is not taken, the parties responsible may not be held accountable.” Firstly, Ilchert says that following an automobile accident, the victim should notify his or her insurance company immediately and an investigation into the accident should begin. “This is the point at which an accident lawyer should be called in,” says Ilchert. “A good personal injury law firm will immediately begin an investigation into the accident and leave no stone unturned.” During the investigation, Ilchert says that there are a number of claims, most of which have filing deadlines, which should be submitted to the appropriate agencies. These claims may include accident reports to the Department of Motor Vehicles, no-fault claims, claims for lost wages and disability, notices of claim, and claims with the defendant’s insurance company, just to name a few. “Filing all of these claims, which vary depending on the nature and the specifics of the accident, can be a very daunting and arduous process and that’s why most people look for a quality personal injury law firm to help them through,” says Ilchert. “The last thing an accident victim needs is to worry about the process. An accident victim needs to rest, recover, and know that his or her best interests are being tended to.” Established for more than 50 years, Lurie, Ilchert, Mac Donnell & Ryan LLP, located at 475 Park Avenue South (32nd Street) New York, NY, 10016, specializes in representing victims of all types of accidents including construction and demolition, falls from ladders, scaffolds, and roofs, automobiles, trains, and busses, babies with cerebral palsy and other brain damage, general medical malpractice, saws and electrical tools without guards, and slip and fall cases.
