OSHA Fines New York Printing Plant For Various Workplace Hazards  

According to a partner from a leading Manhattan personal injury law firm, the Occupational Safety and Health Administration has fined a Buffalo company for numerous safety hazards at its factory in Depew, New York.

“The Occupational Safety and Health Administration has imposed fines against the firm Worldcolor Buffalo for 27 violations of safety and health standards at its printing facility in Depew, New York,” say George W. According to Ilchert, officials from the Occupational Safety and Health Administration (OSHA) said that if left uncorrected, the violations put workers at risk of serious injury including lacerations, amputation, burns, hearing loss, exposure to asbestos, electric shock, or being caught or trapped in confined spaces or operating machinery.

“In addition to the various safety hazards that the company was cited for, OSHA states that the printing facility lacked a written plan for properly training employees for safety,” says Ilchert. “Also, OSHA claims that the company failed to inform its employees about asbestos in the insulation around pipes and failed to provide a Hepatitis B shots to employees who work in conditions where they are exposed to blood and potentially harmful bacteria.”

According to Ilchert, the inspection also revealed that there were repeated instances of improper transfer and storage of flammable liquids, a lack of protective gear for workers and inadequately maintained electrical equipment. Workers were also exposed to an inordinate amount of combustible dust, according to OSHA’s report.

Crane Owner Charged With Manslaughter; Pleads Not Guilty, According to NY Construction Injury Lawyer

James Lomma and a former company mechanic, Tibor Varganyi, were recently indicted in Manhattan Supreme Court on charges of reckless endangerment, assault, and criminally negligent homicide in relation to this horrible construction accident,” says Ilchert. “The accident, which occurred on March 15, 2008, involved giant crane which broke and mashed into an apartment building on the Upper East Side. As a result of the accident, two construction workers, Donald Leo and Ramadan Kurtaj, were killed and the apartment building was damaged.”

According to court documents, Varganyi, 65, selected a Chinese company to fix the crane's turntable, based on lower cost estimates and shorter repair time. Ultimately, Ilchert says, the repair failed, causing the upper part of the crane to break off and fall 200 feet to the ground.

“This horrible construction accident could have been prevented if basic measures had been taken,” says Ilchert. “Those prosecuting the case say that the evidence will show that the defendants were deceitful and not candid with the New York City Building Department and that this deceit ultimately cost two men their lives.”

Reports say that the defendants, on the other hand, say they used a reputable company in China and that the crane had been thoroughly inspected before it was put into use. Even building department officials, they say, signed off on it.

“We are sure that justice will be served and the courts will get to the bottom of this tragic construction accident,” says Ilchert. “However, the construction industry depends on strict adherence to the rules to ensure the safety of construction workers and the people of Manhattan. If the defendants’ negligence caused these deaths, then they should be held responsible.”

WTC Construction Worker Injured In Fall, Says Manhattan Construction Accident Attorney

Staten Island Woman Files Lawsuit Against Doctor After Breast Augmentation Surgery Goes Wrong

According to reports, post-op photos show heavy scarring on Alaimo’s breasts, which appear to be flattened on the bottom and severely swollen on the top.

Dr. Berman, a cosmetic surgeon who has been practicing for 23 years and offers an array of services including breast enhancement and tummy tucks, contends that Alaimo knew the risks before going into surgery and his lawyers say that when it comes to breast augmentation, some bodies respond well to the procedure while others do not.

Manhattan Personal Injury Lawyer Says A Brooklyn Car Accident Has Injured Four, Killed One 


A New York personal injury lawyer says that five people were struck by an SUV after it suddenly accelerated while backing up in a church parking lot.

Reports say that the SUV accelerated suddenly prior to impact.

“Police reports state that a 2010 Mercedes SUV was pulling out of a parking spot at the Pyeong Ahn Presbyterian Church in Brooklyn after dropping off a passenger, when it suddenly sped up and struck a group of pedestrians near the church’s playground,” says Ilchert. “The vehicle then continued backing up at an excessive rate of speed, hitting a fence and another vehicle before finally coming to a halt.”

According to Ilchert, the cause of the sudden acceleration is still unknown and authorities are still trying to piece together the cause of the accident using video from the church’s security cameras.

“Among the victims injured in the accident were three adults and two children,” says Ilchert. “Unfortunately, one of the adults suffered fatal injuries.”

Reports state that two children, ages one and 10, as well as two adults, ages 36 and 41, were transported by emergency medical service crews to Lutheran Medical Center for treatment. Their injuries were not deemed to be life threatening.

NYC Construction Accident Fatalities Dropped in 2009
